Terms and Conditions of WeeCandle.com Online Store

The seller and owner of the Online Store is Rimarif Partners Sp. z o.o. with its registered office in Warsaw at 9/4 Corellego Street, 03-289 Warsaw Poland, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 13th Department under KRS No. 0000521195, NIP 5223018519, whose website and brand WeeCandle.com is owned by.

Definitions

Consumer - a natural person concluding a contract with the Seller through the Store, the subject of which is not directly related to his/her economic or professional activity.

Customer - any entity with full legal capacity, who, under the conditions specified in the Terms and Conditions, makes an Order at the Online Store and for whose benefit services are provided electronically by the Seller.

Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act grants legal capacity, performing a business on its own behalf, who uses the Store.

Account - an electronically provided service created after the Customer registers, where the Customer's data and information and documentation related to his/her Orders are collected.

Shopping Cart - an electronically provided service; a form that is an integral part of and an element of the Store's software, in which the Customer specifies and approves the items and terms of the Order.

Registration - a service provided electronically; a procedure performed by the Customer in order to set up an Account and possibly complete an Order and use certain features of the Online Store.

Order Form - an interactive form available in the Store that allows the Customer to place an Order, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.

Order - a declaration of will of the Customer leading directly to the conclusion of a Sales Agreement and indicating the material terms thereof, made using the Shopping Cart function; Orders may be placed electronically through the Store's sales system, 24 hours a day, 7 days a week throughout the year, subject to the fact that their execution takes place on Business Days from 10:00 am to 6:00 pm; the Customer may place Orders only for available Goods

Merchandise - a product available in the Online Store, which may be the subject of a Sales Agreement; the essential and specific characteristics of each Merchandise are made available on the sub-page of the Store assigned to it.

Newsletter - a free service provided electronically, by means of which the Seller informs the Client about news in the Store, by periodically sending selected and appropriately edited content in the form of an electronic letter.

Privacy Policy - regulations governing the security of privacy protection and processing of Customers' personal data; the Privacy Policy is an appendix to the Regulations, which is available at https://www.weecandle.com/en/privacy-policy.

Regulations - these Regulations of the Online Store; the Regulations are made available free of charge before the conclusion of contracts on the website of the Online Store, as well as - at the request of the Customer - in such a way that allows the Customer to acquire, reproduce and record the contents of the Regulations by means of a data communications system.

Online Store (Store) - Internet service operated by the Seller at https://www.weecandle.com/en/shop/ , using which the Customer may, in particular, place an Order for available Goods.

Seller - the Company of Rimarif Partners Sp. z o.o. with its registered office in Warsaw at 9/4 Corellego Street, 03-289 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the City of Warsaw, 13th Department under KRS No. 0000521195, NIP 5223018519.

Business Days - means the days of the week from Monday to Friday (excluding public holidays).

Order Execution Time - the time during which the order is completed and then issued to the supplier for delivery of the Goods to the address indicated by the Customer; Order Execution Time does not include delivery time

Sales Contract - a contract of sale of Goods within the meaning of the Act of April 23, 1964. POLAND - Civil Code, concluded in accordance with the provisions of these Regulations between the Seller and the Customer, through the Store's sales system

Contract concluded at a distance - a contract concluded with a Customer through an organized system of contract conclusion at a distance (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
 

§ 1. GENERAL PROVISIONS

1. These Regulations define the rules for the use of the Online Store, in particular the conditions for placing an Order and modifying it, setting up and maintaining an Account, making payments, making deliveries, filing complaints, as well as other rights and obligations of the Customer and the Seller. A person wishing to use the services of the Store must read these Regulations in advance.
2. Through the Store, the Seller conducts retail sales of Goods. The Store also makes available to each Customer free services provided electronically 24/7 all days of the year. These services are: Order form, registration and login form, Account, Shopping Cart, Newsletter, product search engine.
3. In order to use the Online Store on the Customer's side, the following minimum technical requirements must be met: a device with access to the Internet, an installed and updated version of the web browser Microsoft Edge, Mozilla FireFox 20.0 or its newer version, Apple Safari 4.0 or its newer version and Google Chrome 23.0 or its newer version, with JavaScript and Cookies enabled, an active electronic mail (e-mail) account. Recommended minimum screen resolution: 1024×768 pixels.
4. The Customer is prohibited to provide unlawful content and use the Store in a manner that interferes with its operation or is burdensome to the Seller and other Customers.
5. Contracts are concluded in accordance with Polish law and in Polish language.

§ 2. REGISTRATION

1. In order to set up an Account and gain the status of a registered Customer, it is necessary to complete the registration procedure beforehand.
2. The User gains the status of a registered Customer following the completion of the necessary registration activities in the Store according to the interactive form. The Customer completes the form by following the relevant messages displayed in the form while completing it (in particular, the Customer provides his/her real data and those marked as mandatory), and then activates the "Register" button.
3. The Customer may also create an Account during the Ordering procedure by activating the "Create Account" button.
4. The Customer, using the functions of the forms, is required to provide his/her true data and complete the fields marked as required.
5. As soon as registration is confirmed by the activation link sent to the Customer's e-mail address, an agreement for the provision of services by electronic means of maintaining an Account with the Seller is concluded for an indefinite period of time.
6. The Customer may terminate the Agreement for maintaining an Account at any time by sending such a statement of intent to the Seller. The termination is effective upon its receipt by the Seller. The Seller may terminate the Agreement for maintaining an Account with a 7-day notice period if the Customer violates the provisions of the Terms and Conditions or generally applicable laws.
7. During the Registration process, the Customer provides a password, through which he/she then gains access to the Account. The Customer is obliged to protect the password and may not share the password with third parties. The Account is non-transferable.

§ 3. ORDER

1. The information contained in the Online Store is not an offer within the meaning of the Act of April 23, 1964. - Civil Code, but constitute an invitation to make offers by Customers.
2. Orders may be placed by Customers who have the status of a registered user of the Online Store or who do not have the status of a registered user of the Online Store. A Customer who does not have a registered Account, makes an Order bypassing the Registration and login procedure.
3. The Customer makes an Order by virtually adding the Goods to the Basket. Successful addition results in changing the indicator of the Goods on the Order list in the Cart tab, which can be freely modified.
4. After confirming the selection of the Goods, the Customer indicates in the Order form the form of shipment of the Order, the form of payment and the address and data for shipment. After completing the Order, the Customer approves it and sends it to the Seller by activating the "Place Order" button.
5. Each time, before sending the Order to the Seller, the Customer is shown a summary of the Order for confirmation purposes, i.e. the total price and details of the Order.
6. In the process of placing an Order, until the "Place Order" button is activated, it is possible for the Customer to detect and correct errors in the Order and modify it, through the Store's sales system. After this moment, the Customer may modify the Order, in particular correct errors in the entered data, until the shipment with the Goods is sent through direct, immediate contact with the Seller.
7. By placing an Order, the Client submits an offer to the Seller to conclude a Sales Contract for the Goods selected by the Client, on the terms and conditions indicated by the Client in the Order. The conclusion of the Sales Agreement is effected by acceptance of this offer by the Seller, at the moment of receipt by the Customer of confirmation of the terms of the Order, sent by the Seller in an electronic message to the e-mail address provided by the Customer in the Order.
8. The content of the concluded Sales Agreement is recorded, secured and made available to the Customer through the Store's sales system, including in the Customer's Account, and is sent to the Customer's e-mail address provided by the Customer when placing the Order. The Customer who has placed an Order and received a statement of acceptance of the offer by the Seller will be provided with a digital document confirming the conclusion of the Agreement with its content, in the manner indicated in the preceding sentence.
9. The Order Realization Time is up to 5 (five) Business Days. Order processing begins in the case of:
a. payment by card the Order Execution Time is calculated from the moment of positive authorization of payment
b. bank transfer - after the payment is credited by the Seller
10. After the aforementioned Order Processing Time, the Goods are released to the carrier.c

§ 4. PAYMENTS AND PRICES

1. The prices shown on the pages of the Store are gross prices (including all duties and taxes, including VAT), expressed in Polish zloty or Euro. The prices of the Goods do not include delivery costs.
2. The total price of the Order is calculated according to the choices made by the Customer in the Order form, in accordance with the rates indicated there. The binding price is indicated to the Customer in the summary of the Order at the time of sending it to the Seller.
3. The Customer is obliged to pay for the Order no later than 3 (three) days from the date of conclusion of the Sales Agreement.
4. A sales document in the form of a registered invoice, or a VAT invoice at the Client's request, is issued for each Goods sold. The sales document is a confirmation of the essential elements of the Order placed.
5. Prices quoted in the Store are subject to change (in particular, as part of a promotional action or sale of Goods), with the proviso that the terms of the Order may not be changed in relation to the Customer, who has made an offer in the manner indicated above, prior to the price change.
6. The online payment service provider is Stripe Inc. based in Dublin, Ireland.
7. Available forms of payment depending on the Buyer's location:
a. payment cards:- Visa- Visa Electron- Mastercard- MasterCard Electronic- Maestro.
b. payment on deliveryec. transfer to the Seller's bank account (account: 43 1140 2004 0000 3102 8012 7489)
c. express payment through the operator Przelewy24
d. wallet payment method GPay, Apple Pay and Link
e. express electronic payment method BLIK, Bancontact, EPS, giropay, iDEAL.
8. Refund of funds in the event of the need to refund funds for a transaction made by the customer, the seller will refund the funds by the same route and to the same bank account assigned to the customer's payment method.

§ 5 SHIPPING

1. Orders are delivered within the Republic of Poland and to selected countries abroad: Austria, Belgium, Czech Republic, Denmark, Estonia, France, Spain, Netherlands, Ireland, Lithuania, Luxembourg, Latvia, Slovakia, Hungary, United Kingdom, Germany, Ukraine, Bulgaria, Finland, Liechtenstein, Romania, Slovenia, Switzerland, Sweden, Italy.
2.Shipments are delivered in the manner selected by the Customer, provided that the Customer may choose one of the following forms of delivery of the Order:
a. DPD, InPost courier company or any other provided by the Seller.
b. parcel machines InPost (when choosing the option "parcel machine InPost" in the comments, please provide the number and address of the parcel machine).
3. The shipping cost is paid by the Customer.
a. The shipping cost is listed on the store's website in the Order Form after the delivery country location selected accordingly.
4. After the Customer selects the shipping type, these costs are added to the Order amount in the summary.
5. The goods are shipped to the address indicated in the Order form. The Seller will contact the Customer immediately if a wrongly filled form prevents effective delivery of the Order.
6. The delivery time of the Order in the territory of the Republic of Poland lasts up to 5 (five) Business Days, calculated from the moment of completion and shipment of the Order by the Seller (completion of the Order Processing Time).
7. If before the shipment is released it is found that it has suffered a loss or damage, the carrier is obliged to immediately establish by protocol the condition of the shipment and the circumstances under which the damage occurred. The carrier should also do this at the request of the Customer if the Customer claims that the shipment is damaged. The danger of accidental loss of or damage to the Goods shall pass to the Customer at the time of delivery to him.

§ 6. COMPLAINTS

1. The Seller is obliged to provide the Consumer with Goods without defects. The Seller is responsible to the Consumer if the 2. Goods have a physical or legal defect (warranty). If the Goods have a defect, the Consumer may make a statement to reduce the price or withdraw from the Sales Contract, or demand replacement of the defective Goods with defect-free Goods or removal of the defect.
2. The warranty is available only to Consumers. The parties, the Customer who is not a Consumer and the Seller, exclude the warranty for defects between themselves.
3. Complaints under the warranty should be submitted to the warehouse address: Rimarif Partners Sp. z o.o., 4 Puszkina Street, 35-328 Rzeszów. In order to facilitate the complaint procedure, the advertised Goods should be delivered together with the proof of purchase and the complaint notification, (i.e. the indication of the person making the complaint, the request to settle the complaint and the indication of the defect of the Goods).
4. The Seller will respond to the Consumer's request within 14 (fourteen) days. The Seller will notify the Consumer of the complaint processing and its result in a message sent to the address provided by the Consumer in the complaint.
5. The complaint procedure applies to services provided electronically by the Seller, respectively. Complaints about services can also be submitted to the e-mail address of the Seller: This email address is being protected from spambots. You need JavaScript enabled to view it.

§ 7 WARRANTY

1. Selected Goods may be covered by a warranty provided by the manufacturer or distributor.
2. In the case of such Goods, information regarding the existence and content of the warranty is indicated on the sub-page of the Online Store dedicated to the given Goods.
3. The warranty does not exclude, limit or suspend the Customer's rights under the warranty regulations for defects of the sold goods.

§ 8 RETURNS

1. A Consumer who has entered into a remote agreement may withdraw from it without giving any reason by making a statement to that effect in writing within 14 (fourteen) days from: (a) for a Sales Agreement - from taking possession of the Goods by the Consumer or a third party other than the carrier designated by the Consumer; (b) for other agreements - from the date of entering into the agreement.
2. If the Consumer has made a declaration of withdrawal from the contract before the Seller has accepted his offer, the offer ceases to be binding.
3. To meet this deadline it is sufficient to send the statement before its expiration. The Customer may use the model statement of withdrawal from the contract, which is attached to these Regulations. It is not obligatory for the Customer to use this template.
4. In the event of withdrawal from the contract, the Seller shall return to the Consumer all payments received, including the costs of delivery of the Goods (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller, immediately, and in any case no later than 14 (fourteen) days from the day on which the Seller was informed about the decision to exercise the right to withdraw from this Contract.
5. The Consumer is obliged to return the Goods to the Seller immediately, but no later than 14 (fourteen) days from the day on which he withdrew from the contract. To meet the deadline it is sufficient to return the Goods before its expiration.
6. The consumer shall be liable for any diminution in the value of the Goods resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the Goods.
7.  The right to withdraw from the contract, the Consumer is not entitled to with respect to contracts indicated in Article 38 of the Act of May 30, 2014. On consumer rights, in particular contracts: in which the subject of performance is an item delivered in a sealed package, which after opening the package cannot be returned for health protection or hygienic reasons, if the package has been opened after delivery, for the provision of services, if the entrepreneur performed the service in full with the express consent of the Consumer, who was informed before the start of performance that after the performance by the entrepreneur will lose the right to withdraw from the contract, in which the subject of performance is a non-fabricated item, produced according to the Consumer's specifications or serving to satisfy his individualized needs, in which the subject of the performance are things that after delivery, due to their nature, are inseparably combined with other things, for the supply of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer before the expiry of the deadline for withdrawal from the contract and after the entrepreneur has informed him of the loss of the right to withdraw from the contract.
8. The direct costs of returning the Goods to the Seller in the situation of withdrawal from the contract concluded at a distance shall be borne by the Consumer.

§ 9. RULES CONCERNING THE USE OF DISCOUNT COUPONS

1. The discount coupon entitles you to a discount (rebate) in the amount indicated by the WeeCandle.com online store. The store reserves the right to change the terms of the promotion at any time. Discount codes have specific expiration dates. After they expire, you will not be able to use the codes.
2. The promotional offer in the form of discount codes applies only to WeeCandle.com customers who, during the promotional period, entered a valid code in the "Coupon Code" field and confirmed it with the "Confirm Code" button when placing an order. Entering the discount code in the field will reduce the value of the ordered goods by the percentage or monetary value of the Discount Code given to the customer.
3. The discount code can only be used when purchasing goods not covered by other promotions. Discount Codes do not combine, do not add up to each other and cannot be used when purchasing products covered by other promotions (unless the terms and conditions of the promotion say otherwise). Only one Discount Code can be used per order.

§ 10. NEWSLETTER AND OTHER SERVICES PROVIDED ELECTRONICALLY

1. Any Customer may resign from any of the services that the Seller provides electronically at any time with immediate effect by refraining from using such service, unless the Terms and Conditions provide otherwise.
2. The Newsletter subscription service is provided free of charge by the Seller to Customers who voluntarily agree to it.
3. In order to subscribe to the Newsletter, the Customer shall perform the following actions:
a. orders through the form available at WeeCandle.com/en/shop and by providing his/her electronic mail address (e-mail) the Newsletter service;
b. accepts the content of the Terms and Conditions and consents to the transmission of commercial information by means of electronic communication related to the Newsletter service provided;
c. activates the "Subscribe" button;
d. activates the link sent to the e-mail address provided in the Newsletter form.
4. As soon as the activation link sent to the Customer's e-mail address is used, a Newsletter service agreement is concluded between the Seller and the Customer for an indefinite period of time.
5. The Customer may terminate the Newsletter service agreement at any time by deactivating the subscription. The Newsletter is cancelled by sending such a declaration of intent to This email address is being protected from spambots. You need JavaScript enabled to view it. or through the "I unsubscribe" button in the email message.
6. Consent to receive commercial information by means of electronic communication sent by the Seller is voluntary and may be withdrawn by the Customer at any time.
7. To use the Wish List service, the Customer activates the "Add to Wish List" button available on the dedicated Goods sub-pages of the Store to add them to the Wish List. Successful addition of the Goods causes the product indicator in the wish list icon to change. In order to use the service of adding to the wish list, the Seller allows that the Customer does not have to be a registered user of the Store.
8. The Seller is entitled to prevent the Customer from accessing the free services if the Customer acts to the detriment of the Seller or other Customers, or violates the law or the provisions of the Terms and Conditions.

§ 11. AMENDMENT OF THE REGULATIONS

1. The Seller may change these Terms and Conditions for important legal reasons (change of generally applicable laws on the activities of Sellers or the form of the Seller's activities) or technical reasons (modernization of the infrastructure of the Store). The reason for changing the Terms and Conditions each time is indicated as indicated below.
2. Registered Users will be informed of the change to the Terms and Conditions in an e-mail sent 14 (fourteen) days before the new Terms and Conditions come into effect. Non-registered Customers will be notified of this in a message displayed on the Store's home page for 14 (fourteen) days before the new Terms and Conditions take effect. During this time, the Customer must again accept or refuse to accept the Terms and Conditions.
3. Orders placed before the effective date of the changes to the Terms and Conditions are processed in accordance with the existing Terms and Conditions.

§ 12. FINAL PROVISIONS

1. The Customer's obligations under the Contract are fulfilled at the time of payment for the Goods and delivery and collection of the Goods, made in accordance with the Order.
2. All materials, including graphic elements, composition of these elements, trademarks and others, available in the Store are the subject of exclusive rights, in particular, they are the subject of copyright protection and industrial property rights. The use of materials available in the Store in any form requires the consent of the Seller each time.
3. In matters not covered by these Regulations, the provisions of common law shall apply, in particular the Act of 23.4.1964. - Civil Code, the Act of November 17, 1964 Code of Civil Procedure and the Act of 30.05.2014. - on consumer rights.
4. In the scope of contracts concluded between the Seller and Customers who are not Consumers, the Seller is liable only in the case of intentional damage and within the limits of actual losses incurred by the Customer who is not a Consumer.
5. A Customer who is a Consumer has the opportunity to use out-of-court means of handling complaints and pursuing claims, in particular, he can request mediation or settlement in an arbitration court. For this purpose, it is necessary to provide the institution before which the proceedings will take place with the appropriate form - a request for mediation or a request for settlement before an arbitration court. If the Customer does not wish to use ADR, any disputes arising under the terms and conditions or sales contracts will be resolved by a court of general jurisdiction. The consumer may also use out-of-court means of handling complaints and claims by submitting his/her complaint through the EU online ODR platform, available at: http://ec.europa.eu/consumers/odr/ . Disputes arising between the Seller and a Customer who is not also a Consumer shall be submitted to the court having jurisdiction over the Seller's registered office.
